TERMS AND CONDITIONS – EWP HOME (AUROPAN FURNITURE COMPONENTS)

 

1.      APPLICATION AND ACCEPTANCE

1.1. These terms and conditions apply to all quotations, orders, deliveries, and agreements between EWP Home, a brand of Auropan Furniture Components, and the consumer regarding the supply of products such as MDF wall panels, parquet floors, and related services.

1.2. By placing an order, the consumer expressly acknowledges having read and unreservedly accepted these terms. Deviations are only valid if agreed upon in writing.

1.3. The applicability of any conditions of the consumer is expressly excluded.

 

2.      PRICES AND PAYMENTS

2.1. All prices are in euros and include VAT, unless otherwise stated.

2.2. Invoices are payable within 14 days from the invoice date, unless otherwise agreed.

2.3. In case of non-payment on the due date, a statutory late payment interest of 8% per year will be due automatically and without notice, in accordance with the Law of August 2, 2002, on late payments in commercial transactions.

2.4. In case of non-payment, a fixed compensation of 10% of the outstanding amount will be charged, with a minimum of €40 and a maximum of €2,500.

2.5. Before collection costs or penalties are charged, a free reminder will always be sent. If no payment follows after this reminder, notices of default may be sent via a lawyer, and all collection costs will subsequently be charged to the consumer.

 

3.      DELIVERY AND TRANSFER OF RISK

3.1. Delivery times are indicative and not binding. A delay in delivery does not entitle the consumer to compensation or termination of the agreement.

3.2. Delivery is made Ex Works (Incoterms 2020), unless otherwise agreed in writing. The consumer bears the risk from the moment the goods leave EWP Home’s warehouse.

3.3. The consumer must inspect the goods upon receipt. Complaints about visible defects must be reported in writing within 5 days of delivery.

3.4. Hidden defects must be reported in writing within 6 months of delivery.

3.5. The prices of the supplied products do not include delivery costs unless explicitly stated otherwise.

 

 

 

4.      RETENTION OF TITLE

4.1. The delivered goods remain the property of EWP Home until full payment, including interest and costs, has been received.

4.2. If the consumer defaults on payment, EWP Home reserves the right to reclaim the delivered goods without prior judicial intervention.

 

5.      LIABILITY AND FORCE MAJEURE

5.1. EWP Home is only liable for intentional misconduct or gross negligence. Under no circumstances is EWP Home liable for indirect damages such as loss of profits or business losses.

5.2. Force majeure, such as strikes, natural disasters, wars, and transport problems, releases EWP Home from its obligations without any right to compensation for the consumer.

5.3. If force majeure lasts longer than 60 days, the consumer may terminate the agreement in writing without compensation.

 

6.      CANCELLATION AND RETURNS

6.1. The consumer has the right to cancel the agreement within 14 days of receiving the goods without stating a reason, provided that the goods are unused and in their original condition and packaging.

6.2. In case of cancellation, the full amount of the order, including standard delivery costs, will be refunded within 14 days. Return costs are borne by the consumer.

6.3. Custom-made products cannot be returned or canceled after order confirmation unless otherwise agreed in writing.

 

7.      WARRANTY AND COMPLAINTS

7.1. EWP Home provides a 5-year warranty on the delivered goods and services, as described in Belgian consumer law.

7.2. The warranty does not cover damage resulting from misuse, insufficient maintenance, or external factors.

7.3. Complaints must be submitted in writing within the specified periods and must be well-documented.

 

8.      DISPUTES AND APPLICABLE LAW

8.1. All agreements are governed by Belgian law.

8.2. In case of disputes, only the courts of the judicial district of Antwerp have jurisdiction.
